摘要
江西是传统工艺类非遗资源大省,手工制瓷、传统制茶等是典型的江右文化资源,是赣鄱传统文化发展繁荣的宝贵财富,具有传承发展和永续利用的重要价值。传统工艺类非遗具有市场属性强、创造空间大、权利主体明等特点,通过保护其相关知识产权可以促进其高质量传承发展。当前,传统工艺类非遗从业者在知识产权方面仍然表现出资金投入不足、保护意识不强、专业辨识不高、权属界定不明等短板,需要各级政府主管部门、传统工艺行业协会等协同发力,加强从业主体宣传、强化知识产权培训、鼓励科研院所参与、引导公益主体介入、开展执法监督合作、增强非遗知识产权力量,构建适合江西传统工艺类非遗高质量传承发展的新路径。
Jiangxi is a province rich in intangible cultural heritage resources of traditional crafts.Handmade porcelain and traditional tea making are typical Jiangyou cultural resources.They are precious wealth for the development and prosperity of traditional culture in Jiangxi province,and have important values for inheritance,development and sustainable use.Intangible cultural heritage of traditional crafts has the characteristics of strong market attribute,large space for creation,and clear rights subject.By protecting its relevant intellectual property rights,its high⁃quality inheritance and development can be promoted.At present,practitioners of intangible cultural heritage in traditional crafts still have some shortcomings in terms of intellectual property rights,such as insufficient capital investment,low awareness of protection,weak professional identification,and unclear ownership.Government departments at all levels,traditional craft industry associations,etc.need to work together to strengthen the publicity of practitioners and intellectual property training,encourage scientific research institutes to participate in,guide public interest entities to intervene,and carry out law enforcement and supervision cooperation,enhance the strength of intellectual property rights and build a new path suitable for the high⁃quality inheritance and development of intangible cultural heritage of traditional crafts in Jiangxi.
