摘要
在《社区矫正法》出台后,社区矫正检察监督制度与该法的衔接和嵌入成为必须思考的重要问题。基于“制度定位—困境分析—对策完善”的研究范式,应当将社区矫正检察监督的功能定位于合法性监督与协同性治理,从而达致“穿透式”监督。通过对当前社区矫正检察监督制度在组织体系、监督衔接、监督形式、监督手段等方面的反思,应从理念转变、制度重塑与技术赋能三个层面进行完善。在理念转变方面,以治理思维为指引,将“法治统一”理念作为基本诉求、“理性谦抑”理念作为价值追求、“功能优化”理念作为根本方法,践行新时代法律监督理念。在制度重塑方面,应从立法规范、组织体系、监督方式、衔接机制、跨区域协作、检察建议等方面进行建构。在技术赋能方面,应当尽快建立和完善统一的社区矫正与检察监督一体化信息平台。
After the promulgation of the Community Correction Law,the connection and embedding of the procuratorial supervision system of community correction with the law has become an important issue.Based on the research paradigm of “system positioning-dilemma analysis-countermeasure improvement”,the function of procuratorial supervision of community correction should be positioned as legality supervision and collaborative governance,so as to achieve “penetrating” supervision.Through the reflection on the present situation of the procuratorial supervision system of community correction in the aspects of organization system,supervision connection,supervision form and supervision means,it should be improved from three aspects:concept change,system remodeling and technical empowerment.At the level of concept transformation,guided by governance thinking,taking the concept of “unity of the law and the rule” as the basic appeal,the concept of “rational modesty” as the value pursuit and the concept of “functional optimization” as the fundamental method,practice the concept of legal supervision in the new era;In the aspect of system remodeling,it is constructed from several aspects,such as legislative norms,organizational system,supervision methods,the linking mechanism,cross-regional cooperation,procuratorial suggestions,etc.In terms of technical empowerment,a unified information platform for community correction and procuratorial supervision should be established and improved as soon as possible.
