摘要
耕地保护是我国的基本国策,广东省承担了先行先试的任务,这体现在广东省委、省人大、省政府出台了大量的法规、规章、行政规范性文件,建立起耕地保护补偿制度的基本框架。审视广东省的耕地保护补偿制度,能够发现存在各级耕地保护补偿制度发展不平衡、耕地保护补偿制度的主体不明确、耕地保护主体的权责分配不清晰、耕地保护补偿的相关制度有待完善、耕地保护补偿的标准与方式不合理的问题。因此,为了提升广东省耕地保护的法治化水平,需要做到统一各级耕地保护补偿制度,厘清耕地保护的补偿主体和受偿主体,明确耕地保护主体的权力(利)和职责,夯实耕地保护补偿的相关配套制度,制定侧重于生态保护补偿的多元化耕地补偿标准。
Cultivated land protection is the basic state policy of China.Guangdong Province has undertaken the task of first trial,which is reflected in the Guangdong Provincial Party Committee,People's Congress and government issued a large number of regulations,rules and administrative documents,and established the basic framework of the compensation system for cultivated land protection.Review the cultivated land protection compensation system of Guangdong province,we can find cultivated land protect compensation system development imbalance among different cities,the subject of the cultivated land protect compensation system is not clear,the distribution of authority and responsibility of cultivated land protection subject is not clear,the correlation system of cultivated land protection compensation remains to be perfected,cultivated land protect compensation standard and method need to be amended.Therefore,in order to enhance the level of rule of law for cultivated land protection of Guangdong province,we need to unify cultivated land protect compensation system between different cities,clarify the subject of cultivated land protect compensation,clear the power and responsibility of cultivated land protection,strengthen the cultivated land protect compensation correlation system,focus on the diversity of cultivated land compensation standards which emphasis on ecological compensation.
