摘要
全面建设数字法治政府是数字政府与法治政府相结合的系统集成目标,必须遵循技术与制度融合的方法逻辑,统筹协调数字技术的赋能作用与法治价值的规制机能,推动政府治理各个领域数字化发展与技术应用各个方面制度化保障的融合治理。在技术赋能上,数字技术助推法治政府现代化转型,实现对法治政府治理理念、组织结构、运行模式的数字化再造。在制度保障上,依托法治规则有效调和技术风险,从政务数据流动的标准化、数字权力运行的程序化与数字问责机制的规范化三个方面,搭建数字政府建设的法治框架。
Building a digital government under the rule of law in an all-round way is the goal of system integration of digital government and law-ruling government.We must integrate technology and institutions,coordinate the enabling function of digital technology and the regulatory function of rule of law value,and promote the integration of digital development in all fields of governance and institutionalized protection in all aspects of technology application.In terms of technical empowerment,digital technology promotes the modernization transformation of the government ruled by law and realizes the digital reconstruction of the governance concept,organizational structure and operation mode of the government ruled by law.In terms of system guarantee,relying on the rule of law to effectively reconcile technical risks,the legal framework of digital government construction is established from three aspects:standardization of government data flow,digital power operation and digital accountability mechanism.
