摘要
基于2015—2021年40所试点单位的227 851项职务发明专利,利用国际专利分类号(IPC)提供的技术创新信息构建适合中国国情的专利质量指标,实证分析了职务发明所有权结构与专利质量的关系。研究发现,在控制专利保护范围、创新水平、主体特征、时间以及技术领域等因素后,科研单位和企业合作发明的专利比科研单位单独发明的专利质量更高;而企业、个人合作发明的专利相对于科研单位发明的专利质量更低。进一步研究发现,专利所有权变更也是衡量专利质量的重要指标,在专利转让时企业和个人会选择更高质量的科研单位发明专利。
Based on 227,851 service invention patents from 40 pilot units from 2015 to 2021,the relationship between the ownership structure of service inventions and patent quality was empirically analyzed by using the technological innovation information provided by the International Patent Classification(IPC)to construct patent quality indicators suitable for the Chinese scenario.It was found that after controlling factors such as the scope of patent protection,innovation level,subject characteristics,the time factor,and technology field,invention patents shared by institutes and enterprises are of higher quality than those invented by institutes alone,while patents of enterprise and individual cooperation is of lower quality compared to institute invention patents.Further study found that the change of patent ownership is also an important indicator of patent quality:enterprises and individuals will select service invention patents with higher quality when transferring patents.
