摘要
农地三权分置改革的直接目的是促进承包地的流转。三权分置权利架构意味着,承包地要以特定方式流转,则必须分置出土地经营权,承包地的流转通过分置土地经营权的方式来实现。三权分置的真正意义在于土地经营权的分置,而非土地经营权的流转。三权分置语境下的农地流转仅指需要分置土地经营权的分置型流转,但在功能主义的立法思路下,立法同时确立了分置后的土地经营权等其他形态的农地流转,由此形成分置型流转与非分置型流转并存的农地流转路径二元化之格局,其法律结构存在根本差异。三权分置语境下,流转一词有其特定法律含义,特指需要新权利分置的农地流转,但农地流转路径的二元化拓展了流转一词的法律含义,立法上的流转一词同时具有土地经营权分置和土地经营权流转两重含义。实证法上出现的所谓流转土地经营权、用承包地的土地经营权流转,土地经营权流转、土地经营权再流转等法律含义复杂而多样,需要在农地流转路径二元化和流转一词法律含义二重性的原理下整合和统一。
The direct purpose of“Three-Rights separation”is to promote the circulation of the contracted management right.“Three-Rights separation”structure means that if the contracted land is to be transferred in a specific way,the rural land management rights must be separated.The circulation of the contracted management right is realized through the separated rural land management right.The circulation of rural land in the context of“Three-Rights separation”only refers to the circulation that requires the separation of Rural land management rights.However,in the functionalism of the legislative thinking,the legislation also establishes other forms of rural land circulation.This forms a dualistic pattern of rural land circulation paths where separation and non-separation coexist,with fundamental differences in their legal structures.In the context of“Three-Rights separation”,the term“transfer”has a specific legal meaning,specifically referring to the circulation of rural land that requires the separation of new rights.However,the dualization of the path of rural land circulation has expanded the legal meaning of the term“circulation”.In legislation,the term“circulation”has both the separation of rural land management rights and the circulation of rural land management rights.The legal meanings of the so-called“circulate land management rights”and“circulation of management rights of contracted land”in empirical law,as well as“the circulation and re circulation of rural land management rights”,are complex and varied.They need to be integrated and unified under the principles of the dualization of the path of rural land circulation and the duality of the legal meaning of the term circulation.
