The Constitutional Implication of Being Responsible for and Reporting to State Power Organs

摘要 “负责并报告工作”得到中国共产党章程和现行宪法的双重肯认,深刻揭示中国共产党立党执政逻辑与依宪治国逻辑的交互作用和有机统一。宪法文本上“负责”与“负责并报告工作”在国家机构体系中呈现差序格局,但“一府一委两院”报告工作之法定化夯实了“负责并报告工作”的完整统一。规范与事实演进的背后蕴含的是人民民主与社会主义两大宪制原理,人民民主形塑了人民主权原则与民主集中制原则,社会主义开释出对民主正当性和治理有效性双重目标的追求。对“负责并报告工作”的法教义学阐释,可以建构其逻辑结构和规范体系,“报告工作”成为填充和夯实“产生-负责-监督”规范逻辑之中枢工程。基于“负责并报告工作”的宪制原理和规范内涵,推进其均衡发展和全面实现,这是坚持和完善人民代表大会制度、发展全过程人民民主的题中之义。 “Being responsible and reporting on work”has been recognized by both the Constitution of the CPC and the current Constitution,highlighting the interaction and organic unity of the CPC's logic of building the party and governing the country in accordance with the Constitution.In the constitutional text,“Being responsible”and“reporting on work”are in a different order in the national institutional system,but the normalization and legalization of the reporting work of“one government,one committee,two courts”actually strengthened the integrity of“Being responsible and reporting on work”.Behind the evolution of norms and facts are the two constitutional principles of people's democracy and socialism.People's democracy shapes the principle of people's sovereignty and the principle of democratic centralism,and socialism releases the pursuit of the dual goals of democratic legitimacy and governance effectiveness.The legal doctrinal interpretation of“Being responsible and reporting on work”can reveal its normative logic and profound meaning.“Being responsible and reporting on work”has become the central project to fill and consolidate the normative logic of democratic centralism of“production responsibility supervision”.Based on the constitutional principle and normative connotation of“being responsible and reporting on work”,promoting its balanced development and full realization is the theme of developing people's democracy in the whole process and adhering to and improving the people's congress system.
