摘要
高质量的市场监管体系是促进全国统一大市场建设的监管基础,而系统厘清市场监管领域研究的理论争议与实践议题对我国市场监管体系的完善有一定的参考价值。本文沿着理论与实践两条主线,首先,对市场监管领域的权力配置、监管职责、监管工具以及监管策略等基本理论争议问题进行了系统梳理和阐释。其次,立足于政策监管实践,对我国市场监管过程中备受关注的多头执法、条块分割、规制俘获以及平台经济的垄断和安全等实践问题展开了文献整理和评述。此外,本文还进一步结合国际经验,对世界各代表性国家的市场监管体制进行了归纳、对比和分析,以期为进一步完善我国的市场监管体系带来借鉴意义。最后,本文结合政策实践,对市场监管领域尚待解决的前沿性问题提出了理性分析与展望,以期为构建高质量的市场监管体系有所裨益。
High-quality market regulation system is the regulatory basis to the construction of a unified national market.Systematically clarifying the theoretical debates and practical issues in the field of market regulation can provide reference value for the improvement of China′s market regulation system.Based on theoretical research and practical cases,this paper first systematically organizes and clarifies basic theoretical issues in the field of market regulation,such as power disposition,regulatory responsibilities,regulatory tools and regulatory strategies.Then,for regulatory practices,the literature review is carried out on the many practical issues in the process of China′s market regulation such as multiple enforcement of law,segmentation,regulation capture,monopoly and security of platform economy.In addition,on the basis of international experience this paper summarizes,compares and analyzes the market regulation system of major countries in the world,in order to further improve the market regulation system of China.Lastly,in view of policy practices,this paper provides a rational analysis and outlook on the frontier issues in the field of market regulation,attempting to help build a high-quality market regulation system.
