摘要
数字教材具有国家事权的基本属性。实践中,法律依据不足、权责与协作规范模糊、监督与保障机制不足等因素导致数字教材落实国家事权存在偏离教材目标与宗旨、虚置事权运转程序、扰乱事权运行秩序、悖反事权指向利益等风险。当前,我国数字教材落实国家事权具有鲜明的标准化路向,并体现填补法律规范不足,促进多元主体参与、程序高效运转、创新发展与应用推广等应然路向。数字教材落实国家事权,既要重视标准化路径建设,还要完善数字教材基本法律依据、优化权责体系配置、人财物保障机制。
Digital textbook has the basic attributes of national duty.In practice,due to factors such as insufficient legal basis,unclear right and cooperation norm,and insufficient supervision and protection mechanism,there are risks in implementing national duty with digital textbook,such as deviating from the goal of it,falsely ignoring operational procedure,disrupting operational order,and contradicting the interest of national duty.At present,implementing national duty with digital textbook in China has a clear standardization direction,which reflects the direction of filling the gaps in legal norm,promoting multiple subject participation,efficient operation,innovative development and application promotion.Its strategy should emphasize the construction of standardized path,improve the basic legal basis for digital textbook,optimize accountability mechanism,and establish mechanism for safeguarding human and financial resource.
