From “Legal System” to “Rule by Law”:The Evolution Logic and Promotion Path of China's Family Education Policy since the Reform and Opening up

摘要家庭教育政策是规范与支持家庭教育发展的重要工具,是推进我国家庭家教家风建设的重要手段。改革开放以来,我国家庭教育政策经历了以边缘性探索为中心的萌芽发展阶段、以系统性规划为抓手的改革发展阶段和以体系化建设为重点的深入发展阶段。在此过程中,其动力机制、价值取向、实施过程保障及话语规则均有其独特的演进逻辑。家庭教育法治化是我国教育治理现代化的必然要求,在未来的发展中我国家庭教育从“法制”走向“法治”,可采取以下推进路径:形成强化基础建设、优质均衡发展的政策动力机制,秉持兼顾个体与社会、协调多元利益的政策价值取向,深化加强顶层设计、完善组织建设的政策实施过程保障,体现深入了解民情、广泛反映民意的政策话语规则。 Family education policy is an important tool to standardize and support the development of family education,and an important means to promote the construction of family style of family education in China.Since the reform and opening up,China's family education policy has gone through the embryonic development stage centering on marginal exploration,the reform and development stage focusing on systematic planning,and the in-depth development stage focusing on systematic construction.In this process,its dynamic mechanism,value orientation,implementation process guarantee and discourse rules have their own unique evolution logic.The legalization of family education is an inevitable requirement of the modernization of education governance in China.To achieve the transformation of family education from “legal system”to “rule by law”in the future,we can take the following approaches:forming a policy driving mechanism to strengthen the infrastructure construction and to achieve high-quality and balanced development;upholding the policy value orientation of giving consideration to both individuals and the society,and coordinating multiple interests;deepening and strengthening the top-level design,and improving the policy implementation process guarantee of organizational construction;and establishing the policy discourse rules that reflect the in-depth understanding of the public sentiment and widely reflect the public opinions.
