摘要
犯罪记录是国家专门机关对犯罪人员情况的客观记载,犯罪记录的披露会导致拥有特定犯罪记录的劳动者受到求职、就业歧视,从而损害其公平就业权。合理的平衡劳动者、用人单位以及社会公共利益之间在劳动者犯罪记录披露上的要求,是该披露规则运作的目的。文章对我国劳动者犯罪记录披露规则的不足与改进进行探讨,期望对我国劳动领域的犯罪记录披露规则的完善有所裨益。
The criminal record is an objective record of an individual's criminal history maintained by designated state authorities.The disclosure of criminal records can lead to job-seeking and employment discrimination against workers with specific criminal records,thereby infringing upon their right to fair employment.The purpose of the disclosure rule is to reasonably balance the demands between workers,employers,and public interests regarding the disclosure of workers'criminal records.This article discusses the shortcomings and potential improvements of the disclosure rules for workers'criminal records in China,hoping to contribute to the enhancement of the criminal record disclosure system in the field of labor in China.
