摘要
基于比较法的视角,我国行政法法典化成为提升法治水平、规范政府行为的重要议题。当前,我国行政法体系尚存诸多问题,如行政法与实际脱节、日益扩张导致执法出现问题等,且行政角色正经历深刻转变,对行政法体系提出了更高要求。因此,行政法法典化成为必要之举,它不仅能规范行政权力的扩张,提供明确的法律依据,还能提升行政决策的透明度和公众参与程度。借鉴典型国家的行政法典立法实践,我们可以提炼出实践启示,如注重解决实际问题、确保法律体系和谐统一等。在构建符合中国国情的行政法典化路径时,应明确法典化方向,确立基本原则,并细致规划实施步骤与策略。同时,强化立法技术支撑,严格规范法典化编制流程,确保法典的质量和实效性。通过这些努力,我们期望能够构建出具有中国特色、符合现代法治精神的行政法典,为我国行政法治建设提供有力支撑。
From a comparative jurisprudence perspective,the codification of China’s administrative law has emerged as a crucial issue to enhance the level of the rule of law and standardize government be-havior.Currently,China’s administrative law system still faces numerous challenges,such as a disconnection between administrative law and reality,and problems arising from its increasing expansion leading to difficulties in law enforcement.Furthermore,the administrative role is un-dergoing a profound transformation,placing higher demands on the administrative law system.Therefore,the codification of administrative law has become a necessary step.It can not only re-gulate the expansion of administrative power and provide a clear legal basis but also improve the transparency of administrative decisions and public participation.By referencing the legislative practices of administrative codes in typical countries,we can extract practical insights,such as focusing on solving practical problems and ensuring harmony and unity within the legal system.When constructing a codification path for administrative law that aligns with China’s national conditions,it is essential to clarify the codification direction,establish basic principles,and care-fully plan implementation steps and strategies.Additionally,legislative technical support should be strengthened,and the codification process should be strictly regulated to ensure the quality and effectiveness of the code.Through these efforts,we aspire to develop an administrative code with Chinese characteristics and aligned with the spirit of the modern rule of law,providing ro-bust support for the construction of the administrative rule of law in China.
