摘要
文章在论述司法认购碳汇的概念及价值、认购碳汇作为绿色司法机制的本质的基础上,通过对全国各级人民法院发布的52件认购碳汇案件进行梳理分析,揭示出司法认购碳汇已经被我国立法和司法实践所认可,但是更有效、更大规模地应用司法认购碳汇还需要明确以下问题:认购碳汇的目标是生态性修复还是经济性补偿,抑或两者并重;逐步改变区域性认购碳汇的现状,形成全国统一的碳汇认购标准与交易市场;解决认购碳汇中鉴定方法学标准不统一、流程不畅、鉴定难贵、时间长问题;明确认购的碳汇可否二次交易,投资性交易的受益主体为何等。促进我国司法认购碳汇制度的发展的建议:①立法层面明确适用的法律依据和运行机制;②司法层面统一适用的操作流程和相关标准;③社会层面大力推广认购碳汇制度。
Based on discussing the concept and value of judicial subscription to carbon sinks,as well as the essence of subscription to carbon sinks as a green justice mechanism,by compiling and analyzing 52 carbon sink subscription cases issued by people's courts at all levels across China,the paper revealed that judicial subscription of carbon sinks has been recognized by legislation and judicial practice in China.However,for more effective and larger-scale implementation of judicial subscription of carbon sinks,the following issues should be clarified:the purpose of carbon sink subscription is ecological restoration or economic compensation,or both;gradually change the current regional subscription of carbon sinks,and establish a unified national carbon sink subscription standard and trading market;solve the problems of non-uniform identification methodological standards,poor process,complicated and expensive identification,and a long time in the subscription of carbon sinks;clarify whether the subscribed carbon sinks can be traded twice,and what is the beneficiary subject of the investment transaction.The paper suggests improving the development of China's judicial subscription carbon sink system:①On a legislative level,clarify the legal basis and operational mechanisms.②On a judicial level,unify the application of operational processes and related standards.③On a social level,vigorously promote the subscription of the carbon sink system.
