摘要
“诉源治理”自提出以来,面临的问题涉及机制、调解有效性、宣传、立法、协同性、司法角色定位、社会主体潜力和智能化水平等多个方面。基层司法行政机关作为最接近民众的社会治理执行者之一,在诉源治理机制中发挥着至关重要的作用。他们的职责内涵涉及面广,不仅是法律政策的执行者,还是矛盾纠纷预防与化解的重要力量。文章对基层司法行政机关在诉源治理机制中发挥作用进行了阐述,通过对其实践效果的分析,发现其面临的问题,尝试界定基层司法行政机关在诉源治理中的作用,以期提升诉源治理的效能。
Since the proposal of source of litigation governance,it has faced various problems,including mechanisms,mediation effectiveness,publicity,legislation,collaboration,judicial role positioning,social subject potential andintelligence level.Grassroots judicial administrative organs,as one of the executors of social governance closest to the people,play a crucial role in the mechanism of litigation source governance.Their responsibilities involve a wide range of aspects,not only being executors of legal policies,but also an important force in preventing and resolving conflicts and disputes.This article elaborates on the actual positioning of grassroots judicial administrative organs in the mechanism of source of litigation governance.Through the analysis of their practical effects,it identifies the problems they face and attempts to define the expected positioning of grassroots judicial administrative organs in source of litigation governance,in order to improve the efficiency of source of litigation governance.
