摘要
港澳特別行政區基本法規定,特區立法機關制定的本地法律需報全國人大常委會備案審查。「一國兩制」下特區法律的制度性差異與備案審查制度的一體化建設間存在矛盾,這是健全特區本地法律備案審查機制需解決的核心問題。首先,應明確特區本地法律備案審查的權力基礎具有特殊性。
The Basic Laws of the Hong Kong Special Administrative Region(hereinafter referred to as“Hong Kong SAR”)and the Macao Special Administrative Region(hereinafter referred to as“Macao SAR”)stipulate that the local laws enacted by the legislatures of the SARs(hereinafter referred to as“SAR local laws”)shall be reported to the Standing Committee of the National People's Congress for the recordation review.
