摘要
以特定种质资源改进与创新所形成的育种创新成果,具有与特定植物材料难以分离、具备繁殖能力且与特定名称相对应等特点,从而在国家种业监管链条中形成大量与育种创新成果有关的数据信息。这些数据信息是证明育种创新成果权利及归属、认定侵权行为成立与否、确定损害赔偿数额的重要证据。数字技术的广泛应用使得对上述数据信息进行针对性和关联性分析利用成为可能。考虑到相关数据应用与创新保护的紧密关联性,种业监管部门应优化不同监管环节数据信息的衔接,推动数据信息共享共用及向公众公开;育种创新主体应重视育种创新数据信息管理,提升数据应用能力,增强核心种质资源开发应用,构建多元保护机制。
The breeding innovation developed through the improvement of specific germplasm resources has the characteristics such as inseparability from specific plant materials,reproductive capability and correspondence to specific names,thus forming a large amount of data and information related to the breeding innovation results in the national seed industry supervision system.These data and information have become vital evidence for establishing rights,confirming infringement,and calculating damages.With the wide application of digital technologies,it is possible to analyze and utilize the above data and information accordingly.Considering the close link between data applications to innovation protection,seed industry regulatory authorities should continuously optimize the integration of data and information across regulatory stages,promoting data sharing and public access.Breeding innovators should pay full attention to the management of breeding innovation data,improving data application capabilities,enhancing the development and application of core germplasm resources,and establishing diversified protection mechanism.
