摘要
要素登记制度发展的根源在于生产力的发展。从农业时代到工业时代,要素登记制度的功能定位几经变迁,并在数字时代下呈现新的功能定位面向。数据知识产权登记是在传统知识产权登记制度基础上,要素登记制度在数字时代下的新发展。应在总结试点经验的基础上,结合马克思主义政治经济学理论,从生产力与生产关系作用与反作用的发展规律出发,回溯要素登记制度在生产力指引下的历史变迁,把握新质生产力发展中数据要素的全覆盖、动态性作用机制,结合新质生产力发展需求,探索新质数据知识产权登记制度发展新路径。需借助相关理论,在多层次数据要素登记视野下,回归登记对象的“凭证”属性,发挥要素登记制度“激励”潜能,以收益凭证登记锚定要素登记制度,打通促进数据要素流通和价值创造的重要环节,使数据要素更好地发挥促进新质生产力发展的核心作用。
The foundation of the factor registration system lies in its alignment with productivity development.From the agricultural era to the industrial age,the functional orientation of the factor registration system has evolved,taking on new roles in the digital age.Data intellectual property registration represents a significant advancement of the factor registration system in the digital era,building upon the traditional intellectual property registration framework.Drawing on pilot experiences and grounded in Marxist political economy theory,we must examine the historical evolution of the factor registration system under the guidance of productivity.This involves analyzing the interplay between productivity and production relations to understand the comprehensive and dynamic role of data elements in fostering the development of new quality productive forces.In this context,exploring innovative approaches to developing a new-quality data intellectual property registration system becomes crucial.Using the correlation theory,we can return to the"voucher"attribute of registered objects through a multi-level data element registration framework.By unlocking the"incentive"potential of the factor registration system and anchoring it with income voucher registration,we can strengthen the essential connections that facilitate the circulation and value creation of data elements.This will enable data elements to play a more central role in driving the development of new quality productive forces.
