摘要
十年磨砺,律师调解制度逐步实现从公益性向市场化的转型,律师在调解活动中的功能定位亦相应变化。自杭州市试点市场化解纷工作以来,律师通过市场化运作参与调解,相关制度设计不断完善,但亦面临诸多问题:如律师兼职调解活力有限、诉讼解纷“吸附”作用明显、案件来源市场化不足、律师调解法律性质模糊等。为此,应当打造专业队伍、增强机制建设、完善数字平台、明确属性定位,以加快推动律师市场化调解工作提质增面。
After ten years of grinding,the lawyer mediation system has gradually realized the transformation from public welfare to marketization,and the functional positioning of lawyers in mediation activities has also changed accordingly.Since the dispute resolution work in Hangzhou pilot market,lawyers have participated in mediation through market-oriented operation,and the relevant system design has been continuously improved,but it also faces many problems:such as the limited vitality of lawyers'part-time mediation,the obvious"adsorption"role of litigation dispute resolution,the lack of market-oriented case sources,and the ambiguous legal nature of lawyers'mediation.To this end,we should build a professional team,strengthen mechanism construction,improve the digital platform,and clarify the attribute positioning,so as to accelerate the improvement of the quality and scope of lawyers'market-oriented mediation work.
