摘要
预制菜产业作为推动乡村产业高质量发展的重要领域深受党和国家的高度关注,保证预制菜食品安全关系人民群众生命健康的核心利益。伴随着预制菜产业的蓬勃发展,预制菜食品安全也暴露出标准体系尚待明晰、认证体系不够健全、追溯体系存在瑕疵、监管体系留有纰漏的问题。基于对我国中央与地方食品安全规范性法律文件的实证考察,明晰预制菜食品安全的现实困境,通过宏观、中观、微观视角廓清预制菜食品安全的法治保障路径,以明晰预制菜食品安全标准体系、健全预制菜食品安全认证体系、优化预制菜食品安全追溯体系、完善预制菜食品安全监管体系的法律规则作为法治回应的进路思考。
Pre-made dishes industry,as an important area which promotes the high-quality development of rural industry is highly concerned by the Party and the state.Ensuring food safety of pre-made dishes is related to the core interests of people’s lives and health.However,along with the booming development of the industry,food safety of pre-made dishes has also exposed the problems of unclear standard system,the incomplete certification system,flaws in the traceability system,and faults in the regulatory system.Based on the empirical investigation of China’s central and local normative legal documents about food safety,the realistic dilemma of food safety of pre-made dishes is clarified,and from the macro,meso and micro perspectives,the path of law guarantees for ensuring food safety of pre-made dishes is stated.Rules of law on clarifying food safety standard system,completing food safety certification system,optimizing food safety traceability system,and improving food safety supervision system should be established.
