摘要
数据是促进新质生产力形成和发展的优质要素,其关键在于依法促进数据有序有效流通。在数据流通中需统筹好“赋权保护”与“行为规制”两种理念与方式,前者侧重以赋权激励来释放数据价值,后者通过设定数据行为的不当性识别基准来框定数据正当权益的边界,两者具有相对独立的运行逻辑和保护法益,最终目标都是为了促进数据要素实现发展动能。促进数据流通须平衡好安全与发展的关系,在高水平安全基础上激励和支撑数据高质量发展。这需要从数据要素特征着力,鼓励数据要素在市场机制作用下以公平竞争来保障数据的流通共享,进一步完善数据要素的市场竞争规则,维护数据要素市场秩序。在此基础上,建立健全公开数据保护规则,树牢数据领域以“公开换保护”的理念和基本原则,让数据在有序流通中释放加乘效应,加快推动新质生产力形成和发展。
Data serves as a crucial element fostering the formation and advancement of new-quality productivity,promoting the orderly and effective circulation of data under legal frameworks.In the process of data circulation,it is essential to strike a balance between two concepts and methods of"empowerment protection"and"behavior regulation".The former focuses on releasing data value by empowering incentives,while the latter frames the boundary of legitimate rights and interests of data by setting the benchmark for identifying improper data behaviors.Both have relatively independent operation logic and protection benefits,and the ultimate goal is to promote the realization of the development momentum of data elements.To promote the flow of data,it is necessary to balance the relationship between security and development and encourage high-quality data development on the basis of a high level of security.For this,we need to focus on the characteristics of data elements,encourage data elements to ensure the circulation and sharing of data.through fair competition under the role of market mechanisms,further improve the market competition rules of data elements,and maintain the market order of data elements.On this basis,establish and improve open data protection rules,establish the concept and basic principles of"open for protection"in the data field,so that data can release the additive effect in the orderly circulation,and accelerate the formation and development of new-quality productivity.
