摘要
为了建立科学、合理的生态修复法律制度,最大限度地恢复和保护受损环境。通过实践调查,发现我国生态修复法律制度存在多法交织权责不一、内容空泛操作性不强、生态环境修复责任主体界定不清、生态环境修复标准不清晰、生态环境修复资金来源单一、资金使用管理不力等诸多问题。考察与借鉴国外先进生态修复成功经验,结合国情,依据生态修复法律理论基础,提出制度完善路径:完善生态修复专项立法,基于“系统性”建立生态修复标准,建立包括主体、生态修复基金、监管的生态修复多元治理机制。
In order to establish a scientific and reasonable biological restoration law and restore and protect the damaged environment to the maximum extent,through practical investigation,it was found that there are many problems in Chines ecological restoration laws,such as overlapping of laws and unclear responsibilities,vague content,weak operability,unclear definition of ecological restoration responsibility subjects,unclear ecological restoration criteria,single source of ecological restoration funds,and ineffective management of ecological restoration funds.By studying and learning from the successful ecological restoration experience of foreign countries and taking into account the national conditions of China,a path for system improvement is put forward based on the theoretical basis of ecological restoration law:perfect the special legislation on ecological restoration,establish ecological restoration criteria based on“systematic”principles,and establish a multi-dimensional governance mechanism for ecological restoration,including the subject,ecological restoration fund,and supervision.
