摘要
在经济法中,将作为发展权实际享有者的区域定性为法律关系主体更为准确。新发展阶段,应重视宏观调控法律制度对实现区域协调发展目标的强大促进作用,精准定位我国区域协调发展现状,明确宏观调控法律制度的改进方向。我国区域协调发展规模扩大,政策类型多样;产业政策适应性提高,因地制宜加快培育和发展新质生产力;发展方式由简单的“政策倾斜”向“帮助发展”迈进。同时也暴露出发展主体选择随意,发展精度不高;区域宏观调控政策混乱,制度化水平不高;区域法定权限不足,发展主动性缺失的问题。以协调发展、共享发展、创新发展的新发展理念为制度改进定向,进一步为宏观调控法律制度定则:有效评价区域发展程度,提高发展精度;区分制度类型,提高制度化水平;拓展区域法定权限,鼓励自发性合作。由此推动中国式现代化进程,深化经济法学区域理论的研究。
In economic law,it is more accurate to define the region of the actual owner of the right to development as the subject of legal relationship.In the new stage of development,we should attach importance to the strong impetus of the macro-control legal system to the goal of regional coordinated development,accurately orientate the status quo,and make clear the improvement direction of the macro-control legal system.The coordinated regional development of our country has expanded in scale and diversified in policy types;the adaptability of industrial policies has improved,and the cultivation and development of productive forces of new quality have been speeded up in light of the local conditions;and the development mode has progressed from simple“preferential policies”to“assistance in development”.Meanwhile,it also exposes that the subjects of development are arbitrarily selected,the development precision is not high,the regional macro-control policies are in disorder,the institutionalization level is not high,the statutory limits of authority are insufficient,and the initiative for development is lost.We shall orient the system improvement under the new development ideas of coordinated,shared and innovative development,and further formulate the rules for the legal system of macro-control:Effective evaluation of regional development level and improvement of development accuracy;system types shall be differentiated and the level of institutionalization shall be improved;regional statutory authority shall be expanded and voluntary cooperation shall be promoted.Therefore,we can further promote the process of Chinese modernization and deepen the study of regional theory of economic law science.
