摘要
整体回避是刑事回避的应有之义,也是程序正义的充分体现。现行回避制度存在重大缺陷、现行立法只规定个体回避而未规定整体回避、检察监督缺位削弱回避制度的规范运行等是公安机关回避制度面临的现实窘境。程序正义价值、制度构建的深刻法理基础、异地侦查管辖提供的实践参照及提升执法公信力需要等是公安机关整体回避制度建构正当性的展现。公安机关整体回避制度的建构可以通过立法规定侦查整体回避制度、设置整体回避的告知启动和决定程序、拓展整体回避的适用范围、赋予管辖权异议以羁束公安侦查权、增设有限定条件的无因整体回避制度、完善管辖移转型指定管辖和异地侦查管辖、设立自行回避义务主体与滥用无因回避申请者的违法责任等基本路径实现。
The overall avoidance is the necessary meaning of criminal avoidance,and it is also a full manifestation of procedural justice.The current avoidance system has significant deficiencies,the current legislation only stipulates individual avoidance without specifying overall avoidance,and the lack of prosecutorial supervision weakens the standardized operation of the avoidance system,which are the practical difficulties faced by the public security organs in the avoidance system.The value of procedural justice,the profound legal basis for institutional construc-tion,the practical reference provided by remote investigation jurisdiction,and the need to enhance law enforcement credibility are all manifestations of the legitimacy of the overall avoidance system construction of public security organs.The basic path for constructing the overall recusal system of public security organs is to establish legislation to establish a system for investigating the overall recusal,establish a notification and decision-making procedure for the overall recusal,expand the scope of application of the overall recusal,grant jurisdictional objections to restrain public security investigation power,establish a limited unconditional overall recusal system,improve the designated jurisdiction for jurisdictional transfer and remote investigation jurisdiction,as well as establish the subject of self recusal obligation and the illegal liability of applicants who abuse the unconditional recusal.
